1. Terms of use

This section sets out the terms governing the use of the Succès Académique website and services. It specifies that the website content is protected by copyright and may only be used in connection with tutoring activities within the company. Any other use is strictly prohibited without prior authorization. In the event of a dispute, the parties must first attempt to resolve the matter through mediation before resorting to the courts, with jurisdiction in the judicial district of Montréal and in accordance with the laws of Québec and Canada.

1.1 Definition

In these Terms and Conditions, the term “Succès Académique” refers to the incorporated tutoring company operating under that name.

1.2 Copyright Infringement

The Succès Académique website and all of its content, including logos, text, images, videos, layouts, and designs, are protected by copyright laws. Users are authorized to use this material solely in connection with tutoring activities within the company. Any commercial use or sharing with third parties is strictly prohibited. No part of Succès Académique’s content may be reproduced, distributed, displayed, downloaded, or transmitted without the company’s prior written authorization.

1.3 Disputes

In the event of a dispute between the company and its users, the parties agree to first use an alternative dispute resolution method, such as mediation, before considering legal proceedings. If the dispute cannot be resolved amicably, it will be submitted to the competent courts of the judicial district of Montréal. The applicable laws are those of the Province of Québec, followed by the applicable federal laws of Canada.

2. Use of our services

This section describes Succès Académique’s commitments regarding the quality of its services, without guaranteeing that they will meet all of your expectations. It also outlines the conditions relating to termination of access to services, cancellation policies, service guarantees, and our commitment to maintaining a violence-free work and learning environment. Please review this information carefully to fully understand your rights and obligations as a user.

2.1 Limitation of Commitments

Succès Académique is committed to providing its clients with the best possible service in a professional and satisfactory manner. Notwithstanding the foregoing, the company cannot guarantee that the Services will meet your expectations, satisfy your specific needs, or comply with applicable professional or industry standards. You acknowledge and agree that Succès Académique’s total liability to you for any actions, claims, disputes, debts, demands, or damages arising in connection with these terms shall be limited in accordance with the provisions of the Disclaimer section.

2.2 Termination of Access to Services

Succès Académique reserves the right, without prior notice and at its sole discretion, to modify the Services, discontinue providing the Services to you or to all users, or impose restrictions on their use. We may also temporarily or permanently terminate or suspend your access to the Services without prior notice and without liability, for any reason, including if we determine, at our sole discretion, that you have breached any provision of this agreement, or even without any specific reason.

2.3 Non-Violence

At Succès Académique, we are firmly committed to maintaining a work and learning environment free from violence. We condemn all forms of violent behaviour, including threats and physical or verbal aggression, and we strive to ensure that all interactions between our tutors and clients take place in a respectful and safe environment. Our non-violence policy is designed to provide an environment in which everyone feels protected and valued, thereby promoting a positive and constructive experience for all. Any violation of this policy will be taken very seriously and handled in accordance with our disciplinary procedures.

2.4 Registration Fee

A one-time registration fee of $29.99 (+ taxes) per family applies upon the first session. This fee covers file setup, needs assessment, and personalized tutor matching. It is part of our satisfaction guarantee and is charged after the first session only if you are satisfied with the tutor.

2.5 Satisfaction Guarantee

If you are dissatisfied with your first tutoring session, Succès Académique will refund the cost of up to one (1) hour of tutoring. This guarantee applies only to the first session with the tutor and is intended to ensure that the tutor-client match meets your expectations.

2.6 24-Hour Cancellation Policy, Late Arrivals, and Absences

To cancel or reschedule a tutoring session without charge, you must notify us at least 24 hours before the scheduled session by contacting your tutor directly. If this notice period is not respected, a fee equal to the cost of the scheduled session may be charged. If the student does not attend the session or arrives more than 30 minutes late, the same policy applies. Finally, if you schedule a first session with us and fail to attend without prior notice (a no-show) and then cease all communication, the one-time registration fee of $29.99 (+ taxes) will also be charged, in addition to the cost of the session.

2.7 Interest and Collection of Outstanding Balances

Any outstanding balance remaining unpaid thirty (30) days after the invoice date will bear interest at a rate of 2% per month (24% per year), calculated monthly and compounded on the outstanding balance until payment is made in full. After notice has been provided to the client, any invoice that has remained unpaid for forty-five (45) days may be referred to an external collection agency if no amicable resolution can be reached. All collection costs shall be borne by the client.

3. Disclaimer

3.1 Limitation of Liability

To the fullest extent permitted by applicable law, Succès Académique makes no warranty or representation and assumes no liability with respect to its tutoring services. A tutor may not be available if a request is overly specific. The company disclaims any liability for any loss or damage arising from the use of its services. Succès Académique shall not be held liable for the consequences of the actions of a tutor, student, or parent, including any inappropriate conduct or violation of the law.

3.2 Acceptance of Risk

By accessing, using, and purchasing the Services offered by Succès Académique, you acknowledge and fully accept the disclaimers and limitations of liability set out in these Terms and Conditions, except where otherwise required by applicable law.

4. Changes to the Terms and Conditions

These Terms and Conditions may be updated periodically. In the event of significant changes, we will notify you by email before the changes take effect. We encourage you to review this page regularly to stay informed of any updates.
